Welcome to AetherWave Studio. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By creating an account or using AetherWave Studio, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use our service.
2. Description of Service
AetherWave Studio is an AI-powered platform for creating:
- Music and audio content
- Images and album artwork
- Videos and animations
- Related media content
3. Account Registration
3.1 Eligibility
You must be at least 13 years old to use our service. If you're under 18, you must have parental consent.
3.2 Account Security
- You are responsible for maintaining the security of your account
- You must not share your account credentials
- You must notify us immediately of any unauthorized access
- One account per person unless explicitly authorized
4. Credits and Payments
4.1 Credit System
- Our services operate on a credit-based system
- Credits are consumed when generating content
- Different features have different credit costs
- Credit costs are displayed before generation
4.2 If a model is unavailable
AI providers have outages. When the model you picked cannot run, we may offer a comparable model from a different provider so that you still get a result instead of an error. A backup can differ in price and in capability.
- If the backup costs more than the price shown, we tell you the new price and you choose whether to proceed
- You are not charged unless you accept
- If the backup costs the same or less, we simply run it
- The model that actually produced your result is recorded with it
4.3 Purchases
- All purchases are processed securely via Stripe
- Prices are in USD unless otherwise stated
- Credits do not expire while your account is active
4.4 Refunds
- Unused credits may be refunded within 14 days of purchase
- Credits consumed for content generation are non-refundable
- Refund requests should be sent to [email protected]
5. User Content and Ownership
5.1 Your Content, Your Rights
You own the content you create using AetherWave Studio. This includes music, images, videos, and other media generated through our platform. You may use, distribute, monetize, and license your creations as you see fit.
5.2 License to Us
By uploading or creating content on our platform, you grant us a limited license to:
- Store and display your content within the platform
- Process your content for generation requests
- Create backups for data protection
This license is solely for operating our service and does not give us ownership of your content.
5.3 Promotional Use of Public Creations
When you choose to make a creation public, you grant AetherWave Studio a non-exclusive, worldwide, royalty-free license to feature, display, reproduce, and share that creation to promote the service, including on the AetherWave platform, our website, and our social media channels (such as Instagram, X, Facebook, TikTok, and YouTube). We credit you by your AetherWave username, or by a social handle you have provided, whenever practical. This license applies only to creations you have made public. Private creations are never used for promotion. You can opt out at any time by making the creation private, deleting it, or contacting us at [email protected], and we will stop featuring it going forward. This license does not transfer ownership of your content, which remains yours.
5.4 AI-Generated Content Disclosure
We encourage transparency. When sharing AI-generated content publicly, we recommend disclosing that it was created with AI assistance, especially for:
- Commercial releases
- Contest submissions
- Professional portfolios
5.5 Creative Analytics & Progression
When you create content using AetherWave Studio, we analyze characteristics of your creative output to enhance your experience. This includes:
- Emotional themes and stylistic patterns in your work
- Audience resonance and engagement metrics
- Longitudinal creative development over time
This analysis generates a Creative Profile associated with your account. Your Creative Profile accumulates as you create, reflecting your artistic journey on the Platform.
Your creative investment is recognized. The metrics you build through your work are yours. Creative Profile data may be used to personalize your experience, generate insights about your artistic evolution, and unlock features, rewards, or experiences. What they unlock will reveal itself in time.
6. Platform Administration and Account Access
6.1 Administrative Access
To provide support, enforce these Terms, investigate abuse, and improve the platform, authorized administrators may:
- View your account information, usage data, and content
- Access your account in a read-only capacity to diagnose issues or investigate reported abuse
- Review content you have created, uploaded, or shared on the platform
- Take moderation actions including content removal, account suspension, or credit adjustments
Transparency commitment: All administrative access is logged with timestamps and the reason for access. We do not use admin access to monitor creative expression or censor content based on viewpoint. Admin access is limited to enforcing these Terms, responding to support requests, and preventing platform abuse.
6.2 Abuse Prevention
To protect the platform and all users, we employ automated and manual abuse detection measures including:
- IP address logging at account creation and login
- Detection of multiple accounts created from the same network
- Monitoring of unusual credit consumption patterns
- Automated flagging of accounts that exhibit abuse indicators
Accounts found to be engaged in abuse (including multi-accounting, credit farming, or exploiting promotional offers) may be suspended or terminated, and any credits obtained through abuse may be revoked without notice.
7. Acceptable Use
7.1 You May
- Create original music, images, and videos
- Use generated content for personal or commercial purposes
- Share and distribute your creations
- Collaborate with others on projects
7.2 You May Not
- Generate content that infringes on others' copyrights or trademarks
- Create deepfakes or non-consensual intimate imagery
- Generate content depicting minors in inappropriate contexts
- Create content promoting violence, hate speech, or illegal activities
- Impersonate real people without their consent
- Generate, publish, or commercially use the name, image, likeness, voice, or persona of any real person, including any celebrity or public figure, without that person's consent
- Use the platform for spam, scams, or fraud
- Attempt to reverse-engineer or exploit our systems
- Resell or redistribute credits
- Create multiple accounts to abuse free tiers
7.3 Your Inputs, and Checking Your Outputs
You are solely responsible for everything you submit to the platform, including prompts, descriptions, uploaded images, audio, video, reference material, and brand assets. You represent that you hold all rights necessary to submit that material and to use the results, and that doing so does not infringe any third party's intellectual property, privacy, or publicity rights.
Generative AI can produce output you did not ask for. A generated person may unintentionally resemble a real individual, and generated text, marks, or designs may unintentionally resemble existing ones. We do not review generated content before it reaches you, and we cannot detect or prevent an unintended resemblance. You are responsible for reviewing any output before you publish it, advertise with it, or otherwise use it commercially, and for confirming that it does not infringe anyone's rights. If output resembles a real person or an existing work, it is your responsibility not to use it that way.
This responsibility sits with you whether a resemblance was intended or accidental, and whether or not the underlying AI model permitted the request. A model provider allowing a generation is a content-moderation decision. It is not a licence, a legal clearance, or advice.
7.4 Content Ownership and Commercial Rights
You retain ownership of any original content you create using AetherWave Studio, including music, images, videos, and comics. You may use your creations commercially, including:
- Selling or licensing your generated content
- Using generated content in commercial products, marketing, and publications
- Publishing and distributing your creations on any platform
- Using generated music, images, and videos in commercial projects
Commercial use rights are available on all paid plans (Starter and above). Free-tier users may use content for personal, non-commercial purposes only.
7.5 API and Programmatic Access
AetherWave Studio offers API access on qualifying plans. The following rules apply to programmatic and API usage:
- API access is intended for integrating AetherWave capabilities into your own applications and workflows
- You may build applications that use AetherWave's API for your own users, provided your application adds meaningful value beyond simply reselling raw API access
- You must not present AetherWave-generated content as originating from a different AI service
- Rate limits and fair use policies apply to all API access
- Bulk or high-volume API usage may require an Enterprise agreement - contact us for custom pricing
7.6 Prohibited Commercial Activities
The following commercial activities are not permitted without a separate written agreement:
- Reselling AetherWave credits or API access at a markup without adding value
- White-labeling the AetherWave platform as your own product
- Scraping, bulk-downloading, or systematically collecting generated content for dataset creation
- Using automated systems to generate content at scale for the sole purpose of resale
- Operating a competing service that relies primarily on AetherWave's infrastructure

7.7 Fair Use and Rate Limiting
To ensure a quality experience for all users, AetherWave reserves the right to:
- Throttle or temporarily limit generation requests during periods of high demand
- Implement per-user rate limits based on plan tier
- Flag accounts exhibiting automated or bot-like usage patterns for review
- Suspend accounts engaged in credit abuse, multi-accounting, or exploitation of free-tier benefits
7.8 Content Retention and Storage
Generated content is stored according to your plan tier's retention policy. We do not guarantee indefinite storage of generated content. You are responsible for downloading and backing up any content you wish to keep. Storage limits and retention periods vary by plan and are subject to change with notice.
8. Intellectual Property
8.1 Our IP
AetherWave Studio, our logo, and platform features are our intellectual property. You may not copy, modify, or distribute our branding without permission.
8.2 Third-Party Content
Do not use our platform to infringe on third-party intellectual property. This includes:
- Copying existing songs or artworks
- Using copyrighted characters without permission
- Replicating trademarked brands
9. DMCA and Copyright
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA).
9.1 Reporting Infringement
If you believe content on our platform infringes your copyright, send a DMCA notice to:

Include: (1) Your contact information, (2) Description of the copyrighted work, (3) Location of the infringing content, (4) Statement of good faith belief, (5) Statement of accuracy under penalty of perjury, (6) Your signature.
9.2 Counter-Notice
If your content was removed and you believe it was a mistake, you may submit a counter-notice with the required legal statements.
10. Disclaimers
10.1 Service Provided "As Is"
AetherWave Studio is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
10.2 AI Limitations
- AI-generated content may not always meet your expectations
- Generation results can vary
- We do not guarantee specific outcomes
- AI models may occasionally produce unexpected results
11. Limitation of Liability
To the maximum extent permitted by law, AetherWave Studio and its operators shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Content created by users
- Third-party actions or content
Damage Cap: You agree that any claim against AetherWave Studio shall not exceed fifty US dollars ($50.00), regardless of the nature of the claim or the amount of any actual damages incurred. By using our service, you waive any right to seek damages in excess of this amount.
This limitation applies to all claims, whether based in contract, tort, strict liability, or any other legal theory.
12. Indemnification
You agree to indemnify and hold harmless AetherWave Studio from any claims, damages, or expenses arising from:
- Your use of our service
- Content you create or upload
- Your violation of these Terms
- Your violation of any third-party rights
13. Account Termination
13.1 By You
You may close your account at any time by contacting support. Upon closure:
- Your account will be deactivated
- Your data will be deleted per our Privacy Policy
- Unused credits are forfeited unless refund is requested within policy
13.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Abusive or fraudulent activity
- Extended inactivity (with prior notice)
- Legal requirements
14. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or platform notification. Continued use after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
